Workplace Discrimination

What is discrimination?

Discrimination generally refers to treating one person or group of people less well than another because of particular attributes such as race, religion, marital status, age, sex, sexual preference, pregnancy, disability, family responsibilities, political opinions or union involvement.

Each state or territory may vary slightly from this list.
It is unlawful to discriminate even when it was not your intention to do so.

Effects of discrimination in the workplace

Effects of discrimination in the workplace can include:

  • Low staff morale
  • Decrease in productivity
  • High staff turnover
  • Increased absenteeism
  • Poor company image
  • Legal and counselling expenses

How do you resolve discrimination issues?

The law states that every employer must not discriminate against any of their employees. An employer has an obligation to educate and enforce the protection of its employees from discrimination.

It is your legal right to speak up if you or your fellow employees are being discriminated against.
Contact your supervisor or senior manager if appropriate or seek the support of your union representative.

Employees who suffer discrimination may apply to the Federal Human Rights and Equal Opportunity Commission or a State Tribunal.
